1. About these Terms of Use
1.1 The website www.ilakh.com, including its account area, and the official ILAKH social media pages (together, the "Platforms") are owned and operated by ILAKH GARMENTS L.L.C ("ILAKH", "we", "us", "our"), a limited liability company licensed by the Dubai Department of Economy and Tourism under Commercial License No. 1440714, with its correspondence office at Level 41, Emirates Towers, P.O. Box 31303, Dubai, United Arab Emirates. Full company details are in our Legal Notice. The Site is designed and maintained on our behalf by We-Go S.r.l.
1.2 These Terms of Use, together with our Privacy Policy, Cookie Policy and Intellectual Property Notice (the "Terms"), govern your access to and use of the Platforms. The purchase of ILAKH Editions is governed separately by our Terms and Conditions of Sale.
1.3 By accessing the Platforms you confirm that you have read and agree to the Terms. If you do not agree, please do not use the Platforms.
1.4 We may modify the Terms by publishing a revised version with a new effective date. Continued use after publication is acceptance of the revision.
2. Permitted use and prohibited conduct
2.1 The Platforms are provided for your personal use: to discover ILAKH, view the collection, purchase Editions and contact us.
2.2 You must not, and must not allow anyone else to:
– use the Platforms unlawfully, including in breach of the laws of the United Arab Emirates or of the country from which you access them;
– copy, scrape, crawl, download, mirror, frame or republish any part of the Platforms or their Content (Article 4), or use any automated tool or artificial-intelligence system to extract or train on Content;
– reproduce product photography, campaign films, the collection booklet, Collector Card artwork or certificate designs for any commercial purpose, including to advertise pieces for resale on third-party platforms in a manner that suggests ILAKH's involvement;
– attempt to gain unauthorised access to any account, server or database, or probe or test the security of the Platforms;
– introduce malicious code or interfere with the operation of the Platforms;
– impersonate any person, misrepresent your affiliation with ILAKH, or present yourself as an ILAKH ambassador, partner or authorised seller without our written agreement;
– place orders through automated means, using multiple identities, or otherwise in breach of the eligibility and quantity provisions of the Terms and Conditions of Sale;
– post or send content that is defamatory, obscene, infringing or contrary to UAE public order or morals; or
– remove or obscure any copyright, trademark or serial-number marking.
2.3 We may suspend or terminate your access and cancel any pending order, without notice or liability, where we reasonably believe you have breached the Terms. Conduct described in Article 2.2 may also constitute an offence under Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes.
3. Accounts
3.1 You may register an account to place orders and view your order history. Keep your credentials confidential and tell us at info@ilakh.com immediately if you suspect unauthorised use. You are responsible for activity under your account.
3.2 We may suspend or close an account, or require a password change, where we suspect a security breach, fraud or misuse. You may close your account at any time by contacting us, subject to the retention periods in our Privacy Policy.
4. Intellectual property
5. User content
4.1 The Platforms and everything on them — the ILAKH name and the ILAKH skull emblem, the Chess and Camo designs and every other design, print, pattern, embroidery and box configuration, the gold ILAKH symbol, the Collector Card artwork and rarity-tier names, the Certificate of Authenticity and booklet designs, photographs, films, text, software and page layouts (the "Content") — are owned by or licensed to ILAKH GARMENTS L.L.C and protected by Federal Decree-Law No. 36 of 2021 on Trademarks, Federal Decree-Law No. 38 of 2021 on Copyright and Related Rights, Federal Law No. 31 of 2006 on Industrial Property and equivalent laws worldwide.
4.2 You may view the Platforms and print or save extracts for personal, non-commercial reference, keeping all proprietary notices intact. No other licence is granted.
4.3 Ownership of an Edition gives you ownership of that physical object and the right to display, wear, lend, gift or sell it. It does not transfer any copyright, design right or trademark in the Edition or its components, and does not permit reproduction of the design, the emblem or the card artwork. See the Intellectual Property Notice.
5.1 If you tag @ilakh, use our hashtags or otherwise share photographs, videos, reviews or comments featuring ILAKH or an Edition ("User Content"), you retain ownership but grant ILAKH a worldwide, royalty-free, non-exclusive, sublicensable licence to reproduce, adapt, publish and display that User Content, in whole or in part, on the Platforms and in ILAKH communications, for as long as the underlying rights subsist, and you agree that we may credit or omit your name or handle at our discretion. Tell us at info@ilakh.com if you would like specific User Content withdrawn from our channels and we will do so where reasonably practicable.
5.2 You warrant that you own or are licensed to use the User Content, that any person appearing in it has consented, that it is not misleading and that it complies with Article 2.2. We may remove User Content at our discretion.
5.3 Unsolicited ideas, designs or proposals sent to us are treated as non-confidential and non-proprietary; ILAKH may use them without obligation.
6. Accuracy, availability and links
6.1 We take reasonable care to keep the Platforms accurate and current but do not warrant completeness or accuracy and may correct or update information without notice. Edition sizes, availability and prices are as stated at the time of order under the Terms and Conditions of Sale. Product images are illustrative; the handcrafted nature of Editions means small variations occur.
6.2 Access may be interrupted for maintenance, security or reasons beyond our control. We do not guarantee uninterrupted or error-free access.
6.3 The Platforms link to third-party services (Stripe, FedEx tracking, social media). We are not responsible for their content or practices, and a link is not an endorsement.
6.4 You may not link to the Platforms in any way that suggests association with or endorsement by ILAKH, or that damages our reputation, without our prior written consent.
7. Authorized sales channel and authenticity
7.1 New ILAKH Editions are sold exclusively through www.ilakh.com and directly by ILAKH. We do not operate or authorise any other retail channel, marketplace listing or social media shop for new Editions.
7.2 Editions may change hands between collectors. ILAKH is not a party to those transactions, gives no warranty in respect of them and is not responsible for their authenticity, condition or price. Before acquiring a piece from a third party, we recommend that you ask ILAKH to verify the edition and serial number against our register at info@ilakh.com.
7.3 Nothing on the Platforms is investment advice. Statements about limited production, rarity or numbering describe the Editions; they are not a representation about market value.
8. Disclaimer and liability
8.1 To the fullest extent permitted by law, the Platforms and Content are provided "as is" without warranty of any kind.
8.2 To the fullest extent permitted by law, ILAKH and its officers, employees and agents are not liable for any indirect, incidental, consequential, special or punitive loss, or any loss of data, profit, resale value or opportunity, arising from your use of or inability to use the Platforms or reliance on Content.
8.3 Nothing in these Terms of Use excludes liability for death or personal injury caused by our negligence, for fraud or gross negligence, or for any liability that cannot be excluded under UAE law. Your rights in respect of an Edition you purchase are set out in the Terms and Conditions of Sale.
8.4 You will indemnify ILAKH against any claim or loss arising from your breach of the Terms or misuse of the Platforms.
9. Privacy and cookies
Our Privacy Policy and Cookie Policy describe how we handle personal data and cookies and form part of these Terms.
10. General
10.1 Severability. Invalid provisions are severed; the rest continue in force.
10.2 Waiver. Failure to enforce is not a waiver.
10.3 Assignment. We may assign these Terms to an affiliate or successor; you may not assign them without our consent.
10.4 Language. These Terms of Use are published in English.
10.5 Governing law and jurisdiction. These Terms of Use are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai. The onshore courts of Dubai have exclusive jurisdiction, without prejudice to any mandatory right you have as a consumer to bring proceedings in your country of residence.
